Wrongful Death

A unique and challenging kind of claim in tort law is the wrongful death claim. A potential wrongful death claimant should make sure to find an attorney who is knowledgeable and experienced in the special rules regarding the procedures involved in making the claim and the nature and extent of the damages which can be recovered in a claim. George Hamo & Associates has successfully prosecuted many wrongful death claims.

Wrongful death is a type of damage that accrues to particular people because of the death of another. In order to recover this type of damage, a claimant must still establish a defendant's actionable tort liability for the events that resulted in the person's death. We are compassionate about our clients' loss, and feel their grief totally and are able to relate and express this loss to a jury. We feel and understand your loss.

Medical Malpractice

Medical errors occur in all phases of practice. Hospitals, emergency room doctors and staff may fail to properly diagnose injuries. Nurses or pharmacists may inadvertently provide incorrect medication or fail to provide the proper dosage. Surgeons may make errors in the course of their procedures that cause serious, and sometimes fatal, injuries. In other cases, doctors fail to provide the proper care for the condition, even though they have properly diagnosed it, or they may have misdiagnosed the medical problem.

The basic medical requirement for proper medical care is called the "standard of care." This is the recognized procedure for diagnosing and treating illnesses and injuries. While the law recognizes that doctors, nurses and other medical providers do not guarantee successful treatment, it does require that medical practitioners provide proper care to their patients. If the care provided does not meet the standard, medical providers, including doctors, nurses and hospitals, are liable for the injuries and harm that result. These damages include loss of wages, medical bills, additional medical treatment, and pain and suffering caused by negligent medical care. We employ top experts in the fields of medicine to assist us and you in proving your case.

Complex Personal Injury - Catastrophic Injuries

Catastrophic injuries caused by car wrecks, product-related accidents, medical malpractice, or industrial accidents require detailed investigation to show fault and ensure adequate recovery for the victim and their family. With our experience and understanding of each critical case component, appropriate recovery for catastrophic injuries such as spinal-cord injury, brain injury, amputation, death and severe burns can be maximized.

We employ top experts that will provide detailed reports on your lifetime expenses due to your injury. Your future depends on it!

Automobile Negligence

Strict time limits apply when seeking compensation for a motor vehicle accident, whether you are a driver, passenger, or pedestrian. You should seek medical attention immediately and this should be followed by legal advice as soon as possible.

Many of the most serious traffic incidents involve pedestrians and motorcyclists. Lacking any protection whatsoever, a pedestrian or motorcyclist is completely vulnerable to serious injuries when struck by a moving vehicle. Even a relatively slow-moving vehicle can cause fractures and other major injuries to a pedestrian or motorcyclist due to the significant momentum of the vehicle's mass and the hardness of the vehicle's outside surfaces in comparison to human flesh.

Of course, people in vehicles sustain tremendous and disabling injuries as well. We work with your medical and rehab specialists to ensure your maximum health recovery, and to ensure your maximum monetary recovery.

Premises Liability

Slip and Fall cases are called Premises Liability claims. These claims involve injuries sustained on the property or premises of a negligent third party.

Slip and fall claims result from a fall caused by a defective condition, foreign substance or object. Crucial to recovery is being able to show how long the defect or substance was there, how visible it was, and how much notice the owner had of the dangerous condition before the accident. Early investigation of these claims is imperative.

Dangerous and Defective Products

When an unsafe product causes an injury or death, the resulting claim is called a "product liability claim." A product liability claim may occur when a product has a design or manufacturing defect or when the manufacturer provides inadequate instructions for use or warnings about the hazards the product presents. When the same product has injured a number of people, they may join together in a group or class action to pursue recovery for their injuries. Product liability cases and class actions are complex. They require an investment of time and money in order to produce a result that reflects the impact the injury has had on the families and survivors of the defective product. We know how to successfully pursue product liability claims and class actions for our clients. We find the important documents that prove the case, locate and prepare experts and explain the case to the judge and jury in a way that makes them understand our clients' injuries and the damages they have suffered.

Mr. Hamo has represented clients against insurance companies, manufacturers, distributors, and retailers in cases pertaining to a broad array of products, including consumer goods, chemicals, power tools, manufacturing equipment, lawn mowers, ladders, cranes, scaffolds, bicycles, all terrain vehicles and handguns.

Legal & Professional Malpractice

The Legal and Professional Malpractice practice involves cases brought against attorneys, accountants and other professionals. In many of these cases, the professional is alleged to have deviated from the applicable standard of care for the profession and as a result has caused financial and other losses to an individual or business. Such cases demand the experience, knowledge and resources George Hamo & Associates can bring to properly investigate and pursue the claim. The investment in technology enables the firm to provide the best possible offense through the use of computerized research and access to relevant data. Quality experts whom we locate for you are typically required for these cases.

Securities Fraud

The team at George Hamo & Associates litigates securities fraud claims on behalf of injured shareholders. These cases typically assert claims against at least one corporate defendant, its brokers and/or its auditors. Often, these cases revolve around brokerage firm mismanagement, churning the account, improper advice and self-dealing. These cases are frequently arbitrated, as most clients have signed an arbitration agreement with their brokerage firm.
